Section A – General Terms & Conditions

  1. DEFINITIONS

    In the Terms -
    1. Account Holder” means the holder of the Player Account.
    2. Accumulative Bet” means a bet placed as a simultaneous prediction of outcomes of events which are completely independent of each other, and in respect of which –
      1. The winning amount is the amount of the bet wagered multiplied by the combined odds;
      2. The total odds are calculated as a multiplication of all the odds of all event outcomes included in such combination bet; and
      3. A winning outcome requires all outcomes of all the events included in such combination bet to have been predicted correctly by you.
    3. Applicable Laws” means in respect of any person, subject matter, action or document, each and every applicable statute, law, regulation, ordinance, rule, judgment, common law, international law, order, administrative determination and decree enacted, adopted, issued or promulgated by any supra-national, national, state, provincial, municipal or local government (including any subdivision, court, administrative agency or commission or other authority thereof), or any governmental department, or any agency, regulator, court, entity, commission, board, ministry, bureau, or authority of any of the foregoing, or any quasi-governmental or private body exercising any regulatory or other governmental or quasi-governmental authority or function, whether in effect as at the date of these Terms or thereafter, to which a Party is subject and which are applicable to the exercise of that Party's rights or the performance of that Party's obligations under these Terms.
    4. Customer” or “you” or “your” means any person who applies for a Player Account, in whose name a Player Account is opened, who places a bet with Sunbet, a guest to our Platforms or user of the Services, as the context may indicate.
    5. Error” means, without limitation, a mistake, misprint, misinterpretation, mishearing, misreading, mistranslation, spelling mistake, technical hazard, registration error, transaction error, manifest error, force majeure and/or similar, which may or may not be apparent to Sunbet and/or the Account Holder at the relevant time which has caused or resulted in bets being offered and/or accepted.
    6. Influence Betting” means any act, prohibited by Sunbet, where you, or parties acting in association with you, can influence the outcome of a match or an event whether directly or indirectly, including without limitation, the use of automated tools, artificial intelligence, bots, or any algorithmic systems designed to manipulate betting markets or outcomes.
    7. FIC Legislation” means collectively the Financial Intelligence Centre Act 38 of 2001, as may be amended from time to time.
    8. Intellectual Property” means all intellectual property subsisting in, pertaining to or used on our Platforms or as part of our Services including, patents, designs, inventions, Trade Marks, service marks, domain names and URL’s, sales and user data, databases, trade secrets, methods and know-how, as well as copyright, including all copyright in any logos, devices, designs, multimedia works, software (including both source and object code and any programmers’ or developers’ notes, flow charts, memoranda and design documents), as well as any goodwill and rights of reputation attaching to any of the above.
    9. Limits” means such minimum or maximum amounts as may be stipulated by Sunbet in respect of Stakes, betting markets, specific bet types, odds or pay-outs, as the case may be.
    10. Parties” means collectively Sunbet and you, and “Party” refers to either of us as the context may indicate.
    11. Payout” means a monetary amount or reward distributed to a Customer by Sunbet due to a successful wager, bet, or game outcome, in accordance with Sunbet's predefined odds, rules, and terms of service which may represent the total sum returned to a Customer. This may include the original Stake plus any winnings, or solely the winnings, depending on the specific betting or gaming structure. Payouts are calculated based on the agreed-upon odds or payable for the event or game and are subject to the operator’s policies, including any applicable fees, taxes, or jurisdictional regulations.
    12. Player Account” means an account opened in your name by Sunbet for the purposes of you betting on our Platforms, as more fully described in the Terms.
    13. Rules” means the specific rules applicable to a particular sport or game, as more fully detailed in Sections B and E to M hereto, as may be amended from time to time.
    14. Stake” means the monetary value, consideration or thing of value made by you in placing a bet.
    15. Sports Book” means a platform that allows users to place bets on various events and outcomes, such as the result of a game, player performance, or specific in-game occurrences offering a range of betting options, odds, and markets.
    16. Sunbet”, “we”, “us”, or “our” means Sunbet (Pty) Ltd, a private company duly incorporated under the laws of South Africa, with registration number 2008/014410/07.
    17. Syndicate Betting” means conduct, prohibited by Sunbet, in relation to which Customers act together to place a series of bets on the same event or competition.
    18. Trade Marks” means all registered and unregistered trade marks, trade names, symbols, signs, insignia, emblems, logos and slogans utilised on or in relation to Sunbet, the Platforms and Services.
  2. DISPUTES
    1. The application and enforcement of the Terms is subject to the applicable regulations imposed by the applicable gambling authorities, including without limitation, the Provincial Licensing Authorities (“PLA”) where Sunbet may be licensed.
    2. In the event that a dispute arises between a Customer and Sunbet in relation to the liability of Sunbet to pay alleged winnings to the Customer and/or these Terms, such dispute should be emailed to Support@Sunbet.co.za. Should the reply not be considered satisfactory, and the dispute cannot be resolved between the Parties, the dispute may be referred to the PLA for resolution.
  3. PLAYER ACCOUNT REGISTRATION AND ELIGIBILITY TO BET
    1. In order to place a bet, you must first create a Player Account.
    2. To apply for and create a Player Account, you need to select a unique account name or user ID (as applicable) and a password.
    3. You are solely responsible for ensuring that the information provided at registration of your Player Account (or any updates thereafter) is accurate. Certain details may be editable by you via your Player Account preferences, or by contacting us directly at Support@Sunbet.co.za.
    4. No person may apply for a Player Account or place a bet with Sunbet unless that person -
      1. is a natural person (companies, close corporations and other corporate entities are disqualified from betting) with full capacity to contract;
      2. is 18 years of age or older. Sunbet reserves the right to request proof of age;
      3. has completed in full a Player Account application form and fulfilled any regulatory requirements, inclusive of requirements set out in the FIC Legislation, and been accepted as a Customer by Sunbet;
      4. is not an excluded person in terms of Sunbet’s responsible gambling programme or is not listed as an excluded person by the PLA/s, or is not listed as an excluded person in the national register of excluded persons referred to in section 14 of the National Gambling Act, 2004; or who is a person who is prohibited in terms of any order or law from participating in gambling activities;
      5. is not a person or persons who are precluded from participating in gambling activities as determined in the Sun International Employees, Suppliers, Service Providers and Concessionaires Gambling Policy; and
      6. is not in breach of these Terms.
    5. If you are-
      1. an officer, director, employee, consultant, or agent of Sunbet, Sun International Limited, or any of its direct or indirect subsidiaries (collectively referred to as the “Group”);
      2. a supplier or vendor to the Group;
      3. a bookmaker, betting agent, or any individual involved in the creation, organization, or execution of an event on which Sunbet accept bets (including but not limited to athletes, sportspersons, officials, and members of sports clubs or leagues), you are not permitted to register for a Player Account or make use of any of the Platforms, either directly or indirectly, unless it is part of your employment with the Group. Additionally, no Immediate Family of such individuals may register or use any of the Platforms, either directly or indirectly. For the purposes of this clause, “Immediate Family” includes, but is not limited to, a spouse, live-in partner, dependants, parent, children, or any other person who co-habits with an employee or director of the Sun International Group. 
    6. There are no fees for opening your Player Account. Sunbet is not a financial institution, and any funds in your Player Account are not insured by any government agency. All transactions to and from your Player Account must be conducted in the currencies available through the placing of bets at any given time and will not accrue interest. You must ensure that all payments made into your Player Account are from a source where you are the named account holder.
    7. Sunbet routinely prohibits credit betting. To place a bet, you will need to deposit funds into your Player Account through one of the available methods specified by Sunbet from time to time. Deposits will be credited to your Player Account once the funds reflect in your Player Account. Minimum and maximum deposit Limits may apply based on factors, including but not limited to, your transaction history with Sunbet, the chosen payment method, and other factors determined solely by Sunbet.
    8. You may request withdrawals from your Player Account at any time, provided that all payments made have been received and all other withdrawal requirements, including without limitation compliance with FIC Legislation, have been met. Sunbet reserves the right to partially or fully fulfil any withdrawal request subject to Sunbet’s withdrawal requirements.
    9. To access certain placing of bets, you may be required to download and install specific software as provided on the relevant Platform.
    10. Only Account Holders may place bets or access certain services via the Platforms.
    11. You agree and warrant that your username and password will:
      1. be used solely for personal use; and
      2. not be shared with or disclosed to any third party.
    12. For security reasons, you agree to enter the correct username and password when accessing the Platforms. Failure to do so may result in denied access.
    13. You acknowledge that once the correct username and password have been entered, any activity conducted under your Player Account—whether authorised or fraudulent—will be your responsibility, unless the order or transaction is cancelled in accordance with these Terms.
    14. You agree to notify Sunbet on Support@Sunbet.co.za immediately upon becoming aware of or reasonably suspecting any unauthorised access to or use of your Player Account, and to take all reasonable steps to mitigate any potential loss or harm.
    15. By using the Platforms, you confirm that you are 18 years of age or older and legally capable of being bound by these Terms.
    16. If a Customer no longer agrees to adhere to the Terms, such Customer undertakes to cease operating their Player Account immediately and he/she shall request Sunbet to close the Player Account.
    17. Sunbet will cancel and void all bets and return all money deposited to any Player Account where it reasonably believes that the player is under the age of 18. Accordingly, winnings shall not be paid to any person who is under the age of 18, and such winnings will be dealt with in terms of Sunbet’s internal policies.
  4. REGULATORY COMPLIANCE

    FIC Legislation
    1. You are required to comply with all FIC Legislation, including but not limited to Sunbet’s Risk Management Compliance Programme.
    2. Sunbet is an Accountable Institution in terms of the FIC Legislation and is obliged to comply with the requirements thereof. Sunbet is obliged, amongst other things, to identify its Customers, verify their identities and to perform other regulatory verifications and obligations that are required or as may be necessary in terms of its Risk Management Compliance Programme.
    3. Pursuant to a risk-based approach, Sunbet may implement its own requirements to give effect to the FIC Legislation.
    4. Sunbet will require from you, as a minimum, the following mandatory information (inclusive of proof thereof), as and when Sunbet deems it necessary:
      1. your full name and surname;
      2. your identity number or passport number;
      3. your nationality (non-South African residents only). A copy of a valid passport will be required in respect of Customers who are non-South African residents;
      4. your residential address;
      5. your occupation;
      6. any other field which is marked as mandatory; and
      7. proof of identification of all South African citizens and residents will be required in the form of a copy of either (a) South African identity document/card or; (b) valid South African driver’s licence or; (c) valid South African passport or; (d) valid temporary South African identity document.
    5. Where Sunbet requires proof of your residential address, this may be submitted to Sunbet in any of the following formats (a) municipal or utility bill; or (b) telephone or cell phone account; or (c) letter from an Accountable Institution or financial services provider; or (d) co-habitants declaration; or (e) such other documentation that Sunbet may accept.
    6. A clear and legible copy of the relevant identification documents required from Sunbet from you is to be transmitted by you to Sunbet by way of email, or other means approved by Sunbet.   
    7. Other than minor typographical errors, the proof of identification and other information furnished by the Customer must correspond identically to the information used for registration purposes.
    8. Failure to provide the necessary documentation may result in the suspension or closure of your Player Account, and Sunbet may withhold your Player Account balance until verification is successfully completed.
    9. The Customer undertakes to advise Sunbet, in writing to Support@Sunbet.co.za, of any changes in details that might have an effect on an approved application or the Customers’ creditworthiness, legal capacity, continued eligibility as a Customer, and Customer’s eligibility to gamble responsibly.
    10. The name on your Player Account must accurately reflect your legal identity. Additionally, the name used during Player Account registration must match the name on the credit/debit card(s) or other payment mechanism used for deposits and withdrawals. 
    11. You are permitted to maintain only one Player Account for use on the Platforms. If you have multiple Player Accounts or Player Accounts under different names, you must notify Sunbet immediately on Support@Sunbet.co.za to consolidate them into a single Player Account. Sunbet reserve the right to close any additional Player Accounts. If Sunbet have reasonable grounds to believe that multiple Player Accounts were created for fraudulent purposes, Sunbet may cancel any related transactions and/or suspend any related Player Accounts.
    12. Please refer to our Privacy Notice in respect of your rights in respect of your Personal Information, as well as our practices regarding the collection, use, and protection of your personal information.
  5. CONSENT TO DIRECT MARKETING
    1. By agreeing to these Terms, you consent and agree that Sunbet may send you marketing communications via all of Sunbet’s marketing channels in respect of our products and services, or those of Sun International (South Africa) Limited inclusive of its subsidiaries, our partners, in accordance with Applicable Laws and our Privacy Notice.
    2. You may elect to opt out of receiving marketing correspondence by using the appropriate links in emails to unsubscribe or replying STOP to an SMS or utilizing other means offered by Sunbet to exercise this right.
    3. Please notify Sunbet of any errant marketing communications received following your opt-out request or exclusion request, bearing in mind that opt-outs may only become effective after a reasonable period following the request.
  6. USE OF A PLAYER ACCOUNT
    1. You are solely responsible for the safekeeping and proper use of your Player Account and other information that will enable you to place a bet. As such you agree that:-
      1. third parties are not permitted to transact on your Player Account on your behalf;
      2. it is your sole responsibility to protect your login credentials and passwords; and
      3. any transactions concluded on your Player Account will be deemed to be you.
    2. You accordingly accept all transactions that occur on your Player Account to be your own.
    3. In the event of a dispute regarding the afore-going, the onus of proof shall rest on you.
    4. You undertake that you will not:
      1. apply for, or hold more than one Player Account with Sunbet;
      2. apply for, or hold a Player Account in the name of or on behalf of any other person;
      3. permit or enable any other person to place a bet, directly or indirectly, using your Player Account reference number, user name or personal identification number; and
      4. utilise any business account, banking card to fund your Player Account, or to receive payments from Sunbet.
    5. Sunbet will not honour any transaction concluded contrary to the conditions of this clause and shall not pay out any winnings in respect of any bet placed in contravention of the Terms. You will be responsible for any claims, losses or damages incurred by Sunbet arising out of the use of a Player Account contrary to the Terms.
    6. You undertake to notify Sunbet immediately if you suspect unauthorised access or use of your Player Account. You will be responsible for all bets placed with Sunbet and any payments made by/to Sunbet in respect of any purchase and/or transaction concluded on your Player Account before you notify Sunbet that any of these circumstances has arisen.
    7. Sunbet reserves the right to void any bets found to have been placed by a Customer using multiple accounts.
    8. You are responsible for ensuring the ongoing security of all of your Player Account-related information and indemnify Sunbet against any claim arising from your negligence in failing to adequately protect your Player Account information.
    9. Sunbet reserves the right to use reasonable steps to independently determine the veracity of any information furnished to it by you, and by accepting these Terms you furthermore give your consent in this regard.
    10. In instances where any of the information used for registration which cannot be verified or which differs materially from the proof you have submitted or which differs materially from Sunbet’s own verifications, Sunbet reserves the right to suspend or terminate your Player Account without prior notice.
    11. In such instances, your Player Account will not be accessible and Sunbet shall not accept any liability arising out of such action taken by it.
    12. Sunbet reserves the right to suspend or terminate your Player Account if you have not furnished any mandatory information or where the necessary processes have not been followed, or for any other reason that would render the Player Account non-compliant with the Terms or any regulatory requirements.
    13. While Sunbet implements reasonable and appropriate measures to secure its Platforms, the transmission of information over the internet remains subject to risks beyond Sunbet’s control. By using the Platforms, you acknowledge and accept that you assume all risks associated with transmitting information in this manner. Sunbet shall not, under any circumstances, be liable for any loss, harm, or damage incurred as a result of such transmission. Sunbet reserves the right to request independent verification of any information transmitted via email, and you consent to such verification should Sunbet deem it necessary.
  7. APPLICATION PROCESS
    1. Should you wish to open a Player Account with Sunbet, you shall complete the Player Account application on the Platforms, as amended from time to time.
    2. You hereby warrant that all information provided to Sunbet during the process of opening a Player Account is and shall remain true and correct for so long as you use, enter and/or bet on our Platforms. You hereby undertake and agree, in writing to Support@Sunbet.co.za, to advise Sunbet of any changes in –
      1. the details provided during your application for your Player Account;
      2. your legal status or capacity;
      3. your creditworthiness;
      4. your eligibility to bet, or
      5. any other matter that may reasonably be expected to have a negative impact on your capacity or ability to manage your Player Account in a responsible manner.
    3. In the Player Account application form, you shall indicate whether you wish to bet against 
      1. a cash deposit placed with Sunbet by you from time to time, or
      2. an amount of cash to be drawn by Sunbet as a deposit from your credit card account.
    4. Your Player Account application will be granted, in Sunbet’s sole discretion, if and when Sunbet informs you thereof or accepts a bet after receiving your completed Player Account application form.
    5. Sunbet reserves the right to:
      1. accept or decline an application for a Player Account;
      2. stop accepting bets, close, Limit or suspend the Player Account, assign individual betting Limits to a specific Customer or group of Customers in its sole discretion and without giving prior notice to the Customer(s) concerned; and
      3. conduct financial, criminal and any other type of background verification to establish source of wealth, source of funds and credit worthiness at its sole discretion.
  8. BANKING - DEPOSITS
    1. Unless otherwise permitted by Sunbet for good cause, the total amount of the payment (which includes, without limitation, payment vouchers and bank deposits) must be played through in full, and no winnings can be withdrawn from your Player Account until this has occurred.
    2. You acknowledge that the deposits referred to in this clause will be held and applied as security for the discharge by you of any amount which may become owing by you to Sunbet.
    3. You may make or authorise deposits into your Player Account at any time.
    4. Deposits may be made –
      1. by an electronic transfer of funds into Sunbet’s banking account. In such cases, you may be required to transmit proof of transfer of the relevant funds, reflecting the amount transferred and your Player Account Number, to Support@Sunbet.co.za, in the case of transmission by e-mail;
      2. by depositing cash directly into the banking account of Sunbet. In such cases, you may be required to transmit proof of deposit of the relevant funds, reflecting the amount transferred and the fact that it was cash and your Player Account Number, to Support@Sunbet.co.za, in the case of transmission by e-mail; or
      3. by way of payment vouchers –
        1. Unless otherwise permitted by Sunbet for good cause, the total amount of the payment voucher must be played through in full, and no winnings can be withdrawn from the Player Account until this has occurred, and
        2. No payment voucher may be redeemed, refunded or otherwise exchanged for cash at any time.
    5. Where you make a direct deposit into the banking account of Sunbet, as contemplated in clause 4, a clearing period of at least 48 hours (or until the funds have cleared) will apply before the funds are allocated to your Player Account, during which period no bets will be accepted against any such amount(s) deposited.
    6. Credit card deposits may only be made by the cardholder whose name is displayed on the credit card, which must match the name in which the Player Account is held.
    7. You expressly represent and warrant that you will not make use of a corporate credit card or business account to make deposits into your Player Account.
    8. No interest shall accrue on any deposits held by Sunbet.
    9. Sunbet reserves the right to charge an administration fee on amounts deposited.
  9. ERRORS
    1. Examples of Errors include, but are not limited to, Payouts as a result of:
      1. failure of established risk management controls;  
      2. inappropriate manipulation of offers or settlement procedures as well as any fraudulent activity;
      3. incorrect payouts; and/or
      4. cyber attacks.
    2. Examples of Errors include, but are not limited to, bets accepted:
      1. during technical problems that would otherwise not have been accepted; at odds/prices that have been increased, improved or enhanced from the odds/prices that would have otherwise been offered;
      2. on events/offers that have already been decided or concluded, or in relation to which Sunbet had suspended betting;
      3. on events/offers after the event/match/offer has started (except for live betting bet types);
      4. on markets/events containing participants that are not part of the event;
      5. otherwise than in accordance with the Applicable Laws;
      6. at odds that –
        1. are materially different from those available in the general betting industry at the time the bet was accepted, whereby Sunbet will use a majority of betting industry operators, to determine whether odds offered were “materially different”; and
        2. reflect an incorrect score, standing or ranking situation, including where incorrect odds are offered, as a result of any errors or omissions made in respect of the announcing, publishing, or reporting of a score, standing or ranking situation;
        3. are incorrect where it is clear that the chances of the event occurring at the time the bet was accepted were materially different; and/or
      7. have been placed by someone other than the Account Holder (including where someone has gained access to the Account Holders’ account) or where the Account Holder is victim of fraudulent activity.
    3. In the event of an Error, Sunbet reserves the right to void, amend, cancel, or reclaim any and all Payouts and/or winnings.
  10. PAYMENT OF WINNING BETS
    1. Sunbet shall credit your Player Account in respect of winnings and refunds accruing to you.
    2. In the event of an Error (including, without limitation, if funds are incorrectly credited to your Player Account), you will be obliged to notify Sunbet of the Error without delay.
    3. In the event of any Error, Sunbet reserves the right without prior notification to adjust your Player Account balance accordingly. Any betting transactions processed on the strength of such Error, shall, in Sunbet’s sole discretion, be void.
  11. WITHDRAWALS
    1. The minimum withdrawal amount is R50.00.
    2. You acknowledge that Sunbet will process withdrawal, subject to the Terms.
    3. Sunbet reserves the right to:
      1. perform such investigations or verifications as may be necessary to confirm the amount requested by you;
      2. effect any deductions or adjustments which may be required; and/or
      3. transfer the amount requested to the specific method elected by you.
    4. Further to the above, Sunbet reserves the right to not process any withdrawal request in the following circumstances, including without limitation,:
      1. identification records or proof documentation are outstanding;
      2. non-compliance of the Player Account with any other regulatory or Sunbet requirement;
      3. conflicting or suspicious banking details;
      4. you have not paid to Sunbet any amount that is due to it;
      5. the requested amount exceeds the account balance or which amount is not available in your Player Account; or
      6. in the event of any dispute arising between you and Sunbet.
    5. If a withdrawal request is successful, Sunbet will take the necessary, reasonable steps to give instructions to its financial institution at least 2 business days after the day on which -
      1. your funds became available; or
      2. your funds were confirmed; or
      3. Sunbet’s investigations or verifications were concluded, to effect the payment concerned.
    6. Sunbet has no control over clearance periods or the timing of transactions between its financial institution and your financial institution.
    7. Sunbet is only able to pay out to based payment mechanisms and/or methodologies.
  12. RECOVERY OF AMOUNTS OWING
    1. Sunbet reserves the right to recover amounts from you in the following circumstances:
      1. in the event of a debit balance in your Player Account owing to the Erroneous acceptance of a bet in excess of Limits reflected on the Player Account;
      2. where Sunbet has in Error:
        1. credited a Player Account through incorrect bet settlement and you have spent all or part of the incorrectly credited amount; or
        2. incorrectly allocated funds to a Player Account and you have spent all or part of the incorrectly allocated amount; or
      3. where you place a bet in contravention of the Terms, and such bet is subsequently adjusted with the effect that you have spent all or part of the adjusted balance resulting in a negative Player Account balance.
    2. Where applicable, you shall, on a weekly basis, make payment in full to Sunbet of such amount either by –
      1. depositing the relevant amount directly into the banking account of Sunbet, in which event –
        1. your Player Account number must be entered as the reference on the proof of payment; and
        2. a copy of the proof of payment must be sent to Sunbet by you, or
      2. furnishing Sunbet with written authorisation, in such format as Sunbet shall require, for the recovery by Sunbet of the relevant amount from your bank.
    3. Sunbet may at its own discretion and from time to time determine the manner in which payments by you to Sunbet shall be appropriated in respect of amounts owing by you to Sunbet.
    4. A certificate signed by any director, manager, assistant manager, trader or accountant of Sunbet (whose appointment or authority need not be proved) stating the amount of your indebtedness to Sunbet, shall be prima facieproof of such indebtedness.
    5. Should any bets be placed with monies Erroneously credited to your Player Account, Sunbet reserves the right to void such bets and cannot be held liable for any losses sustained by you.
  13. ADJUSTMENTS

    Notwithstanding anything to the contrary herein contained, Sunbet shall be entitled to set-off any amount(s) due to Sunbet by you against any funds standing to the credit of your Player Account or to realize any security held by Sunbet and to use the proceeds towards payment of any amount due by you to Sunbet.

  15. SUSPENSION OR TERMINATION OF PLAYER ACCOUNT AND/OR BETTING FACILITIES
    1. Sunbet shall have the right, prior to accepting any bet, temporarily to suspend or permanently to terminate, the Player Account and/or the furnishing of betting services to you without providing any reason. Upon such suspension or termination –
      1. Sunbet shall upon your demand, refund to you the balance of any monies held by Sunbet on deposit for you, after adjusting for losses, winnings and taxes and once such funds have been cleared into Sunbet’s nominated bank account, and
      2. any amounts owing by you to Sunbet shall become payable immediately.
    2. You will upon notice to Sunbet be entitled to terminate your contractual relationship with Sunbet at any time after final conclusion of any betting transaction placed by you and after payment by you of all amounts owing by you to Sunbet.
    3. Sunbet shall accept no further bets on a Player Account from you unless and until you request your Player Account be reopened and such request has been accepted by Sunbet.
    4. Sunbet reserves the right, and at its sole discretion, to determine the bet offerings to be made available by it, including but not limited to: the events, markets, all betting options, odds, and the acceptance or refusal of any bets. Sunbet may make available or terminate betting offerings on any sports, events, markets and betting options at its sole discretion and reserves the right to make any changes without notice to you.
  16. REFUND POLICY
    1. Money held in your Player Account may be refunded on request, subject to you notifying Sunbet within a reasonable period to enable Sunbet to verify that the Terms have been complied with, including those requirements listed under clause 11.
    2. Possibility to Win:
      1. In all cases there must be a possibility for either party to win at the time the bet is made, failing which the bet or the affected selection, as the case may be, shall be void.
      2. All bets on contingencies which have already been finally determined at the time of the placement thereof shall be void.
  17. PRIORITY AND DISCLAIMER
    1. Sunbet reserves the right, at its own discretion, to adjust a Payout credited to your balance if it is obvious that the Payout has been credited to the Player Account due to an Error.
    2. In order to adjust any inaccuracy in your balance following amounts credited due to an Error, Sunbet reserves the right to take any necessary action, without prior notice and within reasonable limits, to adjust the Account Holder's balance through the reversal, amendment or cancellation, of any subsequent transaction on the Account Holder's account.
    3. These Terms are applicable to all transactions, and may be supplemented with other Rules. In the event of ambiguity, priority should be considered in the following order:
      1. Rules of third party as may be set out in Section B, and Sections E to M;
      2. Rules of Sunbet as may be set out in Section B, and Sections E to M;
      3. The terms and conditions contained in this Section A;
      4. Any other section of the Terms;
      5. Rules and conditions published in conjunction with an offer and/or campaign; and
      6. Should these be inconclusive, reference will be made to the General Sports Book Rules, unless Specific Sports betting rules declare otherwise.
    4. In cases where it deems that these Terms are inconclusive, Sunbet reserves the right, according to its own discretion, to settle offers on an individual basis on the basis of equity, attaining itself to generally accepted betting norms, customs and definitions.
    5. Any data provided or accessible in, from or related to the Platforms may be used by the Account Holder for private, non-commercial use only and any use or attempted use of such data for commercial purposes is strictly prohibited.
    6. Sunbet has the right to enforce a term of the contract relating to the Sports Book against any Account Holder.
  18. BREACH
    1. SHOULD YOU BREACH ANY OF THE TERMS AND FAIL TO REMEDY SUCH BREACH WITHIN 48 HOURS AFTER RECEIPT OF WRITTEN NOTICE BY SUNBET REQUIRING YOU TO DO SO, SUNBET SHALL BE ENTITLED, WITHOUT PREJUDICE TO ANY OTHER RIGHTS IT MAY HAVE AT LAW, FORTHWITH TO TERMINATE ITS CONTRACTUAL RELATIONSHIP WITH YOU AND TO TERMINATE OR SUSPEND THE PLAYER ACCOUNT AND/OR ANY TRANSACTION INITIATED OR BET PLACED BY YOU, WHETHER ACCEPTED OR NOT, AND/OR TO CLAIM DAMAGES FROM THE YOU (WITHOUT LIMITATION OF ANY OTHER RIGHT OR REMEDY AVAILABLE TO SUNBET). In such event –
      1. all amounts owing by you to Sunbet shall become payable immediately; and
      2. Sunbet shall have a lien and right of retention over all your money deposited with Sunbet, pending settlement of such damages as may have been suffered by Sunbet.
    2. Notwithstanding the generality of the aforegoing, the provisions of clause 1 shall apply if -
      1. you die;
      2. you commit any act of insolvency;
      3. your estate is sequestrated;
      4. you endeavour to compromise generally with your creditors;
      5. your name is entered into the register of excluded persons contemplated in section 14 of the National Gambling Act, Act 7 of 2004 or any other provincial gambling law; and/or
      6. you have been self-excluded from Sunbet in terms of any policy applicable exclusively to Sunbet or in terms of Sun International Group’s policy where Sunbet was selected.
    3. YOU SHALL BE LIABLE FOR ANY LEGAL EXPENSES (INCLUDING LEGAL EXPENSES ON A CLIENT ATTORNEY SCALE, COLLECTION CHARGES AND TRACING FEES) AS WELL AS ANY AMOUNT OF GOVERNMENTAL TAX INCLUDING BUT NOT LIMITED TO VALUE-ADDED TAX, WHICH SUNBET MAY INCUR IN RECOVERING ANY AMOUNTS OWING IN RESPECT OF YOUR PLAYER ACCOUNT OR A RESULT OF YOUR BREACH OF ANY OF THE CONDITIONS OF USE OR THE ENFORCEMENT BY SUNBET OF ANY OF ITS RIGHTS AGAINST YOU.
  19. LIMITATION OF LIABILITY
    1. YOU AGREE THAT YOU MAKE USE OF THE SERVICES AT YOUR OWN RISK AND ASSUME ALL RESPONSIBILITY FOR YOUR RISK USE OF THE SERVICES. EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE, THE PLATFORMS, ALL CONTENT PROVIDED ON OR THROUGH THE PLATFORMS, AND THE SUNBET SERVICES ARE PROVIDED “AS IS”.
    2. SUNBET MAKES NO GUARANTEES AS TO THE AVAILABILITY OF OUR PLATFORMS, MARKETS OR PRICES.
    3. SUNBET WILL NOT ENTERTAIN ANY CLAIMS, AND, TO THE GREATEST EXTENT POSSIBLE UNDER ALL APPLICABLE LAWS, ACCEPTS NO LIABILITY FOR LOSSES SUSTAINED BY A CUSTOMER’S INABILITY TO ACCESS SUNBET MARKETS OR PLATFORMS, DUE TO MALFUNCTION, CANCELLATION OF ACCOUNTS, INABILITY TO PROVIDE MARKETS, SUSPENSION OF SERVICES OR OTHERWISE, REGARDLESS OF THE CAUSE.
    4. TO THE FULLEST EXTENT POSSIBLE UNDER ALL APPLICABLE LAW, THE CUSTOMER INDEMNIFIES SUNBET AGAINST ANY HARM CAUSED DUE TO INACCURATE INFORMATION OBTAINED FROM THE PLATFORMS OR EMPLOYEES, INCLUDING BUT NOT LIMITED TO SPORTS SCHEDULES, LOCATIONS, PRICES OR RESULTS.
    5. SUNBET MAY, AT ITS SOLE DISCRETION AND WITHOUT INCURRING LIABILITY OF ANY KIND, AT ANY TIME SUSPEND THE SUNBET SERVICE IN WHOLE OR IN PART. THE CUSTOMER REPRESENTS AND WARRANTS THAT IT SHALL, TO THE GREATEST EXTENT POSSIBLE UNDER ALL APPLICABLE LAW, INDEMNIFY AND HOLD HARMLESS SUNBET AND ITS LICENSEES, SUCCESSORS, RELATED ENTITIES, DIRECTORS, OFFICERS, AGENTS, MEMBERS AND EMPLOYEES AND SOFTWARE PROVIDER (COLLECTIVELY, THE “SUNBET PARTIES”) FROM AND AGAINST ANY AND ALL DIRECT, GENERAL LOSS OR DAMAGE, LIABILITIES, LOSSES, INTEREST OR PENALTIES OF WHATSOEVER NATURE INCURRED OR SUSTAINED BY THE SUNBET PARTIES AND ANY COSTS AND EXPENSES (INCLUDING, BUT NOT LIMITED TO REASONABLE ATTORNEYS’ FEES) FROM CLAIMS OR ACTIONS AGAINST ANY OF THE LICENSOR PARTIES BASED UPON OR FROM ANY INFORMATION, CONTENT, MATERIALS OR COMMUNICATIONS TRANSMITTED, RECEIVED, DISPLAYED, USED AND/OR CONTAINED ON OR THROUGH THE PLATFORMS AND ANY AND ALL TRANSACTIONS PROCESSED THEREBY, AND/OR ANY INFRINGEMENT OR IMPROPER USE BY THE CUSTOMER OF THE SUNBET SERVICE.
    6. THE CUSTOMER WARRANTS AND REPRESENTS THAT NEITHER THE USE, POSSESSION OR AVAILABILITY OF THE SERVICES BY THE CUSTOMER WILL INFRINGE UPON OR CONTRAVENE ANY APPLICABLE LAWS, IN THE JURISDICTION IN WHICH HE/SHE RESIDES.
    7. NOTWITHSTANDING ANYTHING TO THE CONTRARY, UNDER NO CIRCUMSTANCES SHALL THE PARTIES BE LIABLE TO ONE ANOTHER HEREUNDER FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, LOSS OF BUSINESS, PROFITS, REVENUE, LOSS OR DAMAGE ARISING FROM LOSS, DAMAGE AND/OR CORRUPTION OF ANY DATA.
    8. TO THE GREATEST EXTENT POSSIBLE UNDER ALL APPLICABLE LAWS, THE CUSTOMER INDEMNIFIES SUNBET ITS DIRECTORS, EMPLOYEES AND AGENTS, AND ANY ENTITY WHICH IS PART OF SUN INTERNATIONAL'S GROUP OF COMPANIES AGAINST: (A) ANY LOSS CAUSED BY INCORRECT CREDITS OR DEBITS TO YOUR ACCOUNT, INCLUDING BUT NOT LIMITED TO, INCORRECT DEPOSITS OR WINNING BET PAYOUTS. THE CUSTOMER AUTHORISES SUNBET TO DEBIT ANY AMOUNTS WHICH HAVE BEEN INCORRECTLY CREDITED (THROUGH ERROR, NEGLIGENCE OR OTHERWISE) TO THE PLAYER ACCOUNT; AND (B) ANY OTHER LIABILITY, DAMAGES AND/OR LEGAL ACTION WHATSOEVER AND HOWSOEVER ARISING, INCLUDING NEGLIGENCE ON THE PART OF SUNBET, ITS DIRECTORS, EMPLOYEES OR AGENTS AND SUNBET SHALL NOT ACCEPT LIABILITY FOR ANY DAMAGES OR ANY TYPE OF LOSS SUFFERED BY YOU WHO TRANSACT WITH SUNBET AND MAKE USE OF THE PLATFORMS OR THROUGH ANY ACT OF WRONGDOING OR NEGLIGENCE BY SUNBET OR THE AFORE-GOING PERSONS EVEN BEYOND OF THE USE OF THE PLATFORMS.
    9. SUNBET SHALL NOT –
      1. UNDER ANY CIRCUMSTANCES WHATSOEVER BE LIABLE TO THE CUSTOMER IF THE CUSTOMER’S CREDIT CARD COMPANY AND/OR FINANCIAL INSTITUTION REFUSES TO HONOUR ANY CLAIM LODGED BY SUNBET AGAINST THE CUSTOMER’S CREDIT CARD. NO DISPUTE OF WHATEVER NATURE BETWEEN A CUSTOMER AND THE CREDIT CARD COMPANY SHALL EXEMPT YOU FROM YOUR LIABILITY TO SUNBET IN RESPECT OF PAYMENT AND YOU SHALL NOT BE ENTITLED TO INSTRUCT SUNBET TO REVERSE A PAYMENT INSTRUCTION THAT HAS ALREADY BEEN MADE TO YOUR CREDIT CARD COMPANY;
      2. BE RESPONSIBLE FOR –
        1. ANY FAILURE, MALFUNCTION OR DELAY OF ANY ELECTRONIC FUNDS TRANSFER UNIT OR OTHER CREDIT CARD PROCESSING MACHINE OR ITS SUPPORTING OR SHARING NETWORK, RESULTING FROM CIRCUMSTANCES BEYOND THE CONTROL OF SUNBET, OR
        2. ANY DAMAGES, LOSS OR EXPENSE WHICH THE CUSTOMER MAY SUFFER AS A RESULT THEREOF, AND
        3. BE LIABLE FOR ANY LOSS OR DAMAGE SUFFERED BY THE CUSTOMER AS A RESULT OF THE UNAUTHORIZED ACCESS TO ANY DATA OR AS A RESULT OF INCORRECT INFORMATION SUPPLIED THROUGH AN ELECTRONIC FUNDS TRANSFER UNIT OR OTHER CREDIT CARD PROCESSING MACHINE OR ITS SUPPORTING OR SHARING NETWORK.
    10. THE LIABILITY OF SUNBET TO THE CUSTOMER FOR ANY DAMAGES SUSTAINED BY THE CUSTOMER FROM ANY CAUSE WHATSOEVER INCLUDING ANY DAMAGES ARISING OUT OF THE NEGLIGENCE OF SUNBET OR THAT OF ITS SERVANTS, AGENTS OR SUB-CONTRACTORS, SHALL IN ANY EVENT AND UNDER ALL CIRCUMSTANCES BE LIMITED –
      1. IN THE EVENT OF DAMAGES RELATING TO A BET, TO THE AMOUNT STAKED BY THE CUSTOMER IN RESPECT OF SUCH BET; OR
      2. IN RESPECT OF THE ACCOUNT OF THE CUSTOMER WITH SUNBET, TO THE CREDIT BALANCE OF SUCH ACCOUNT AT THE TIME DURING WHICH THE DAMAGES ARE ALLEGED TO HAVE OCCURRED, AFTER FULL ADJUSTMENT FOR WINNINGS, LOSSES AND TAXES.
    11. TO THE GREATEST EXTENT POSSIBLE UNDER ALL APPLICABLE LAW, NOTWITHSTANDING ANY OTHER PROVISIONS IN THESE TERMS, SUNBET SHALL UNDER NO CIRCUMSTANCES WHATSOEVER BE LIABLE FOR ANY LOSS OF PROFITS, WINNINGS OR POTENTIAL PROFITS OR WINNINGS OR ANY INDIRECT OR CONSEQUENTIAL DAMAGES SUSTAINED BY THE CUSTOMER, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF SUNBET, ITS AGENTS OR EMPLOYEES.
    12. INSOFAR AS ANY OF THE OBLIGATIONS OF SUNBET UNDER THESE TERMS IS/ARE CARRIED OUT BY ANY ITS SERVANTS, AGENTS, SUB-CONTRACTORS, ASSOCIATES OR SUBSIDIARIES, THE PROVISIONS OF THESE TERMS SHALL APPLY MUTATIS MUTANDIS AND EACH OF THEM SHALL BE EXEMPTED ACCORDINGLY.
    13. Any acts of god, war, strike, lock-out or other labour dispute, fire, flood, explosion, the enactment, amendment or repeal of legislation, failure of electricity or any other supplies, failure of telecommunications, failure, theft or default of any computer hardware or software or any other equipment or any other similar or different cause beyond the reasonable control of Sunbet leading to the cessation and/or restriction of the operations of Sunbet, shall entitle Sunbet to postpone its obligations to the Customer in whole or in part, and in such event Sunbet shall not be responsible for any damages of any nature suffered by the Customer, whether directly or indirectly, as a result thereof and the Customer shall not be entitled to terminate its contractual relationship with Sunbet as a result of any such occurrence.
    14. NOTHING IN THESE TERMS (INCLUDING THE LIMITATION OF LIABILITY PROVISIONS) IS INTENDED TO EXCLUDE OR LIMIT ANY CONDITION, WARRANTY, RIGHT OR LIABILITY WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OR EXCLUSION OF CERTAIN WARRANTIES OR THE DISCLAIMER, EXCLUSION OR LIMITATION OF CERTAIN LIABILITIES FOR LOSS OR DAMAGE CAUSED BY WILFUL ACTS, NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF IMPLIED TERMS, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES. TO THE EXTENT THAT THEY ARE HELD TO BE LEGALLY INVALID, DISCLAIMER, EXCLUSIONS AND LIMITATIONS SET FOR IN THESE TERMS INCLUDING THOSE SET OUT ELSEWHERE AND THIS CLAUSE 18, DO NOT APPLY AND ALL OTHER TERMS SHALL REMAIN IN FULL FORCE AND EFFECT. ACCORDINGLY, ONLY THOSE LIABILITY AND OTHER LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION (IF ANY) WILL APPLY TO YOU AND OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY ANY APPLICABLE LAW.
    15. TO THE EXTENT PERMISSIBLE UNDER ANY APPLICABLE LAW, YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION YOU MAY HAVE ARISING OUT OF OR RELATED TO USE OF THE SERVICES OR OTHERWISE UNDER THESE MUST BE FILED WITHIN 1 YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR YOU HEREBY AGREE TO BE FOREVER BARRED FROM BRINGING SUCH CLAIM. THIS PROVISION SHALL BE DEEMED TO CONSTITUTE A SEPARATE WRITTEN LEGALLY BINDING AGREEMENT BY AND BETWEEN YOU AND SUNBET.
  20. DISCLOSURE OF INFORMATION
    1. You acknowledge that Sunbet may be legally required to, and in such cases shall, disclose to any governmental bodies or regulatory agencies, information pertaining to your identity and personal particulars, the Player Account and the activity on such account.
    2. Sunbet shall comply with Applicable Laws and its Privacy Notice when taking any actions under this clause 19.
  21. DOMICILE OF PARTIES
    1. The email address furnished by you on the Player Account shall serve as your domicilium citandi et executandi/legal address for all purposes in respect of these Terms.
    2. The physical address reflected in respect of Sunbet in the Introduction of these Terms, as amended from time to time, shall serve as its legal addressfor all purposes in respect of these Terms.
    3. You will have the right to change your domicile by giving one week’s prior written notice to Sunbet of your change of address to Support@Sunbet.co.za.
    4. Any notice given in terms of this provision which is:
      1. delivered by hand to an officer or manager of Sunbet during the normal business hours of the addressee at its legal address, shall be deemed to have been received by Sunbet at the time of delivery; or
      2. posted by pre-paid registered post to Sunbet at its legal address, shall be deemed to have been received by on the seventh day after the date of posting.
  22. INTELLECTUAL PROPERTY
    1. Using the Sunbet services and Platforms does not give you ownership of any Intellectual Property rights in the Services or the content you access or make use of on the Platforms. You agree that Sunbet owns all Intellectual Property subsisting in the content, Services and the Platforms (“Sunbet IP”).
    2. The Sunbet IP is protected by all Applicable Laws. The owners of such content reserve all such rights therein unless provided otherwise in these Terms.
    3. You agree that you shall not and have no right to:
      1. copy, in whole or in part, the Sunbet IP;
      2. modify, adapt, translate, reverse engineer, decompile, disassemble, re-distribute, re-sell or create derivative works based on the Sunbet IP;
      3. use or register any trade marks, trade names or other devices or incorporate marks which are the same as or confusingly similar to the Trade Marks or which marks are likely to be associated with the Trade Marks or where such use would take unfair advantage of or be detrimental to the distinctive character or the repute of the Trade Marks;
      4. at any time, to do (or cause to be done) anything in any way which or could impair, weaken, damage or be detrimental to any part of our rights, title and interest in and to the Intellectual Property, or the reputation and goodwill associated therewith;
      5. challenge our rights to our current or future Intellectual Property in any country; and
      6. make any unauthorised use of the Intellectual Property or to represent that you have any rights of any nature in the Intellectual Property or any registrations thereof.
    4. Statistics or editorial text published on the Platforms are to be considered as added information but Sunbet does not acknowledge or accept any liability whatsoever if the information is not correct. At all times it is your responsibility to be aware about circumstances relating to an event.
  23. THIRD PARTY CONTENT
    1. Our Platforms may include, from time to time, content or advertisements from third parties and/or external links to other websites possessing their own content (“Third Party Content”).
    2. You acknowledge that certain Third-Party Content –
      1. is beyond the control of Sunbet and that any reliance on any representation, statement or information contained in Third Party Content is at your risk;
      2. cannot be verified by Sunbet, and that Sunbet cannot be expected to determine its accuracy or reasonableness; and
      3. may contain representations, statements or information which does not represent the views, opinions or beliefs of Sunbet, its associates, directors or employees.
  24. RESPONSIBLE GAMBLING & SELF-EXCLUSION

    In line with the principles advocated by the South African Responsible Gambling Foundation (SARGF) and in compliance with the applicable regulatory requirements, we provide the following measures:
    1. Deposit limits whereby you may set daily, weekly, or monthly deposit limits on your Player Account to assist in managing your expenditure. For more information click here .
    2. Cooling off periods whereby you may, at any time, request a temporary suspension of your Player Account by activating a “cooling-off” period. For more information click here .
    3. Self-exclusion whereby you deactivate your Player Account from our Services for a minimum period of 6 months up to 5 years. For more information click here .
    4. By accepting these Terms, you undertake to gamble in a responsible manner, and you hereby release and forever discharge Sunbet, its owners, directors, employees and agents from any liability to you or your heirs, administrators, executors and assigns for any harm, monetary or otherwise, which may arise out of or by reason of any act or omission relating to the gambling on Sunbet’s Platforms and any self-exclusion or your request for removal from any self-exclusion list, including the processing and enforcement, the failure of Sunbet to withhold gambling privileges from or restore gambling privileges to you, or permitting you to engage in gambling activities, and permitting access to our Platforms, whilst being excluded and in respect of disclosure of self-exclusion information, except for a wilfully unlawful disclosure of such information. You furthermore agree to be removed from any promotional competitions that were entered into prior to the self-exclusion and agree to forfeit any winnings and benefits accrued to you in terms of the Sun MVG programme.
  25. DORMANT ACCOUNTS 
    1. Your Player Account may be deemed dormant if you do not:
      1. deposit funds into your Player Account; or
      2. place a bet for a period of 180 days.
    2. If your Player Account remains dormant for more than 180 consecutive days, the outstanding balance in the Player Account may be forfeited in accordance with the applicable PLA’s instructions.  
  26. SECURITY REVIEW AND VERIFICATION
    1. Security Review Rights 
      1. To maintain the security and integrity of the Platforms, Sunbet reserve the right to conduct a security review at any time. This review may be carried out to: 
        1. Verify your identity and age;
        2. Confirm the accuracy of the Player Account information;
        3. Assess your use of the Platforms, including without limitation, compliance with these Terms, Sunbet policies, and Applicable Laws; and/or
        4. Examine financial transactions conducted via the Platforms for potential violations of these Terms or legal regulations.
    2. Authorisation for Verification 
        1. By using the Platforms, you expressly authorise Sunbet (including designated agents or representatives) to conduct any necessary inquiries with third parties to verify the information you have provided or are required to provide under these Terms.
        2. This may include, but is not limited to: 
          1. Requesting and obtaining a credit report;  
          2. Verifying your information against third-party databases; and/or
          3. Disclosing relevant information to third parties as deemed necessary for validation purposes.
    3. Cooperation and Documentation 
        1. To facilitate security reviews, you agree to provide any requested information or documentation at Sunbet’s sole discretion. Failure to comply may result in restrictions, suspension, or termination of your Player Account. 
  27. PASSWORD
    1. Please note that you are required to change your password every 60 days. You are also not allowed to use a password used in the last 180 days.
